This aims to carry out a detailed analysis of the current trustee investment
portfolio, highlight any areas
of concern in relation to the Trustee Act 2000 and offer a solution to
these concerns.
Understanding the changing nature of the investment environment has become an increasingly important, yet onerous, task for trustees. In addition, the introduction of the Trustee Act 2000 has imposed a greater duty of care on trustees to ensure the trust’s investments are managed in the best possible manner, thereby requiring trustees to seek and implement the best investment solutions on offer.
To ensure compliance with the Act it is vital to recognise and understand
changes in the investment
environment and implement a structured review process.
(Note: this also applies to “Controlled Trust”
for solicitors who are managing client’s personal affairs)
How the Programme works?
There are 2 distinct parts to the service:
Initial fact finding and recommendation;
- An initial meeting with the relevant solicitor to collate information about the trust.
- A meeting with the Trustees to introduce our services and explain the processes involved.
- A detailed Trustee Investment and Suitability Report, analysing the trust assets and making recommendations.
- Signed agreement from all the Trustees to proceed.
Subsequent Annual Trustee Review meeting;
- An up-to-date Portfolio Report detailing the performance of the Trustee Assets
- Highlighting of any changes in legislation and in the investment world and providing an update on the progress of the portfolio in relation to the Act.
- Help in completing Trustee Self Assessment Tax forms.
The “Trustee Investment and Suitability report” will cover
the following areas:
- Summary of Recommendations
- The impact of tax on the trust portfolio
- Suitability of the investment assets to meet the objectives
- Asset Allocation
- Suitability of chosen products
- Statement of Charges
- Terms of Business
Key benefits for Trustees
